Being exempt from tax is surely the perfect position to be in. However, tax exemptions do not come easy – to qualify for them, you need to meet various requirements before SARS will relieve you of your tax liability. One of the options to qualify is to be a Public Benefit Organisation.

ProBeta offers a session to discuss and explore both the legal and tax requirements relating to these entities.

This session will address matters including, but not limited to, the following:
• The differences between a Public Benefit Organisation, Non-profit Organisation and Non-profit Company
o Legal requirements and benefits of each
• The requirements to register an entity as a PBO, NPO or NPC including the administrative process and relevant documents needed
• Additional requirements in order to be approved for tax purposes as a Public Benefit Organisation by the Commissioner, including the administrative process and relevant documents needed
• Specific tax measures applicable to Public Benefit Organisations, including exemptions and a discussion on what constitutes Public Benefit Activities for tax purposes
• Brief discussions on the tax rules applicable to Recreational Clubs and Associations
