With CIPC actively conducting Beneficial Ownership compliance inspections, practitioners need to be able to demonstrate that the information submitted is accurate, complete, supported by the entity's underlying records and capable of standing up to inspection.
This practical session takes practitioners from identifying the correct beneficial owners through to filing, record-keeping and inspection readiness.
We will compare the different Beneficial Ownership requirements under the Companies Act, FIC Act, Trust Property Control Act and Financial Sector Regulation Act, and examine the different reporting requirements involving CIPC, the Master’s Office and SARS.
Importantly, we will also work through what happens during a CIPC BO inspection, who must attend, what inspectors may request and what records should be available before an inspection takes place.
For trusts, we will look at the current Beneficial Ownership obligations and separately consider how the draft Regulation of Trusts Bill, 2026, if enacted, could significantly strengthen the Master's oversight, reporting and enforcement framework.
